Terms of Service

1. Acceptance of Terms

By accessing or using DirtBound® by Up North Supply Co. ("we," "our," or "the Company"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services or purchase any digital products.

By purchasing or downloading any Digital Product, you also agree to our License Agreement, which governs your use of all Digital Products. The License Agreement is incorporated into these Terms of Service by reference.

2. Description of Services

DirtBound® provides digital design files, blueprints, templates, and related digital content ("Digital Products") for personal fabrication use. These Digital Products are licensed, not sold, and are subject to the restrictions outlined in this agreement.

3. Account Registration

To purchase Digital Products, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Purchases and Payments

All purchases are final. Due to the digital nature of our products, we do not offer refunds once a Digital Product has been downloaded. Prices are subject to change without notice.

If a chargeback is filed after download, your license is automatically revoked and you agree to destroy all copies of the files.

5. Restrictions on Use

You may not redistribute, resell, or publicly post any Digital Product, in whole or in part. Digital Products may include identifiers or metadata used to detect unauthorized distribution.

Violation of these terms will result in:

• Immediate termination of your account
• Revocation of all licenses and download access
• Potential legal action for copyright infringement
• Liability for damages and legal fees

6. Limitation of Liability

Digital Products are provided "as is" without warranty of any kind. Fabricated items may require modification, reinforcement, or professional installation. You are solely responsible for verifying suitability and safety.

We are not liable for any damages resulting from the use of our Digital Products, including but not limited to personal injury, property damage, or any consequential damages arising from fabrication or use of items created from our designs.

You assume all responsibility for the safe and proper use of our Digital Products and any physical items created therefrom.

7. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Minnesota, United States, without regard to its conflict of law provisions.

8. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting. Your continued use of our services constitutes acceptance of any modified terms.
